Why GDPR matters for AI
The General Data Protection Regulation (GDPR) has been in force since May 2018, but its implications for AI systems continue to evolve. Any AI system that processes personal data of EU residents must comply with GDPR — regardless of where the organization is based.
With the EU AI Act adding AI-specific regulations on top of GDPR, organizations now face a dual compliance challenge. Understanding how these frameworks interact is essential for any organization deploying AI in Europe.
Key GDPR requirements for AI systems
Lawful basis for data processing
Every AI system that processes personal data needs a valid lawful basis under Article 6 GDPR. For AI training data, the most commonly relied-upon bases are:
- Legitimate interest (Article 6(1)(f)) — Often used for AI training, but requires a documented balancing test showing that the organization's interest does not override the rights of data subjects.
- Consent (Article 6(1)(a)) — Must be freely given, specific, informed, and unambiguous. Difficult to obtain retroactively for training datasets.
- Contract performance (Article 6(1)(b)) — Applicable when AI processing is necessary to fulfill a contract with the data subject.
Automated decision-making (Article 22)
Article 22 gives individuals the right not to be subject to decisions based solely on automated processing that produce legal or similarly significant effects. This directly impacts AI systems used for credit scoring, recruitment, insurance pricing, and similar high-stakes decisions.
Organizations must either obtain explicit consent, ensure the decision is necessary for a contract, or have authorization under EU or Member State law. In all cases, they must implement suitable safeguards including the right to human intervention.
Data Protection Impact Assessment (DPIA)
Under Article 35, a DPIA is mandatory when processing is likely to result in a high risk to individuals' rights. Most AI systems that process personal data at scale will trigger this requirement. The DPIA must assess the necessity and proportionality of processing, risks to data subjects, and measures to mitigate those risks.
Data minimization and purpose limitation
AI systems often benefit from more data, but GDPR requires data minimization (Article 5(1)(c)) — only collecting data that is adequate, relevant, and limited to what is necessary. Purpose limitation (Article 5(1)(b)) means personal data collected for one purpose cannot be freely repurposed for AI training without additional legal basis.
Transparency and explainability
Articles 13 and 14 require organizations to inform data subjects about the existence of automated decision-making, meaningful information about the logic involved, and the significance and envisaged consequences. This creates a practical obligation for AI explainability — organizations must be able to describe how their AI systems work in terms that individuals can understand.
GDPR and the EU AI Act: working together
The EU AI Act explicitly states that it complements GDPR rather than replacing it. Key interaction points include:
- High-risk AI systems under the AI Act that process personal data must comply with both GDPR data governance requirements and AI Act data quality requirements
- Fundamental Rights Impact Assessments (Article 27 AI Act) should be conducted alongside GDPR DPIAs
- Transparency obligations under both frameworks overlap — organizations should create unified transparency notices
- Right to explanation — While GDPR provides a right to meaningful information about automated decisions, the AI Act adds specific transparency requirements for high-risk systems
Practical compliance steps
1. Map personal data flows in your AI systems. Identify what personal data enters the system, how it is processed, and what outputs are generated.
2. Document your lawful basis. For each AI system processing personal data, document the specific lawful basis and maintain records of processing activities (Article 30).
3. Conduct DPIAs. For high-risk AI processing, complete a DPIA before deployment. Update it when the processing changes significantly.
4. Implement data subject rights. Ensure individuals can exercise their rights to access, rectification, erasure, and objection in relation to AI processing.
5. Appoint a DPO if required. Organizations that process personal data on a large scale or process special category data must appoint a Data Protection Officer.
