AI Literacy Requirements Under the EU AI Act (Article 4)

What is AI Literacy under the EU AI Act?

Article 4 of the EU AI Act (Regulation (EU) 2024/1689) introduces a binding obligation for AI literacy. Unlike most other provisions that target specific risk categories, Article 4 applies broadly: every provider and deployer of AI systems must ensure that their staff and other persons dealing with AI on their behalf have a sufficient level of AI literacy.

This obligation entered into force on February 2, 2025 — making it one of the first enforceable requirements of the entire regulation. It applies regardless of the risk classification of the AI system in question.

AI literacy, as defined in Article 3(56), means the skills, knowledge, and understanding that allow providers, deployers, and affected persons to make informed decisions regarding AI systems. It encompasses the ability to understand the basic principles of AI, to critically evaluate AI outputs, and to recognize the potential impacts of AI on individuals and society.

Who must comply?

The obligation applies to two main categories of actors:

Providers — organizations that develop AI systems or have them developed and place them on the market under their own name. This includes technology companies, software vendors, and any organization building AI-powered products or services.

Deployers — organizations that use AI systems under their authority in a professional context. This covers businesses using AI tools for recruitment, customer service, fraud detection, content moderation, medical diagnostics, or any other operational purpose.

Within these organizations, AI literacy must extend to:

  • Technical staff who develop, maintain, or modify AI systems
  • Operational staff who use AI systems as part of their daily work
  • Management and decision-makers who authorize the deployment of AI systems
  • Human oversight personnel responsible for monitoring AI outputs
  • Customer-facing staff who interact with AI-generated outputs or assist users

The scope is deliberately broad. The regulation recognizes that AI literacy is not purely a technical competency — it is an organizational capability that must permeate all levels where AI systems are used, developed, or governed.

What does AI literacy actually require?

The regulation does not prescribe a specific curriculum, certification, or training format. Instead, it requires that AI literacy measures be proportionate to the context, taking into account:

  • The technical knowledge of the persons involved, considering their existing education, training, and practical experience
  • The context in which the AI systems are used, including the sector, the risk level, and the potential impact on affected persons
  • The persons or groups on which the AI systems are intended to be used — higher-impact decisions require deeper understanding

In practical terms, AI literacy encompasses three dimensions:

1. Understanding AI fundamentals

Staff should understand what AI systems are, how they work at a conceptual level, and what their capabilities and limitations are. This does not mean everyone needs to understand neural network architectures — but they should understand that AI systems learn from data, can reflect biases present in that data, and may produce incorrect or misleading outputs.

2. Critical evaluation of AI outputs

Personnel working with AI systems must be able to critically assess the outputs they receive. This is especially important for high-risk applications where AI outputs inform decisions about individuals — in employment, credit scoring, healthcare, or law enforcement. Staff should understand that AI outputs are probabilistic, not deterministic, and should know when to override or question an AI recommendation.

3. Awareness of risks and impacts

Staff should understand the potential negative impacts of AI systems, including discrimination, privacy violations, and safety risks. They should also understand the legal framework — at minimum, they should know that the EU AI Act exists, that it regulates AI use, and that their organization has obligations under it.

How to implement AI literacy

While the regulation provides flexibility in implementation, organizations should approach AI literacy systematically. Here is a practical framework:

Step 1: Assess the current state

Conduct an internal assessment of existing AI literacy levels. Identify who in the organization interacts with AI systems, in what capacity, and what level of understanding they currently have. Use surveys, interviews, or self-assessment questionnaires.

Step 2: Define role-based requirements

Not everyone needs the same level of AI literacy. Define what each role needs to know:

  • Leadership: Strategic understanding of AI risks and opportunities, regulatory obligations, liability implications
  • Technical teams: Deep understanding of AI system design, data quality, bias detection, testing methodologies, and technical documentation requirements
  • Operational users: Practical understanding of the specific AI tools they use, how to interpret outputs, when to escalate, and how to apply human oversight
  • Compliance and legal: Detailed knowledge of the EU AI Act, risk classification, documentation requirements, and reporting obligations

Step 3: Develop and deliver training

Create or procure training programs tailored to each role group. Options include:

  • Internal workshops and seminars led by technical staff or external experts
  • E-learning modules that can be completed at each person's pace
  • Hands-on exercises with the specific AI systems the organization uses
  • Regular briefings on new developments in AI regulation and technology
  • Case studies illustrating real-world AI failures and their consequences

Step 4: Document everything

Maintain comprehensive records of your AI literacy program, including:

  • Training curricula and materials
  • Attendance records and completion rates
  • Assessment results and competency evaluations
  • Dates and frequency of training updates
  • Evidence of management oversight and review

This documentation serves as evidence of compliance and should be readily available for inspection by national competent authorities.

Step 5: Review and update regularly

AI literacy is not a one-time exercise. The technology landscape evolves rapidly, and so does the regulatory environment. Schedule regular reviews — at minimum annually — to update training content, assess effectiveness, and adapt to new AI systems or use cases within your organization.

Deadlines and enforcement

The AI literacy obligation under Article 4 became enforceable on February 2, 2025. This means that organizations using or developing AI systems should already have AI literacy measures in place.

Failure to comply can result in penalties under Article 99. While the specific fine for AI literacy violations falls under the EUR 15 million / 3% tier (other obligations), the reputational risk of demonstrably ignorant AI use may be even more significant — particularly if an AI incident occurs and the organization cannot show that responsible personnel understood the systems they were operating.

AI literacy and other obligations

AI literacy is not an isolated requirement — it is foundational to virtually every other obligation in the EU AI Act:

  • Human oversight (Article 14): Effective human oversight of high-risk AI systems requires that overseeing personnel understand the system's capabilities, limitations, and failure modes
  • Risk management (Article 9): Identifying and assessing AI risks requires people who understand what can go wrong
  • Transparency (Article 13): Informing deployers and affected persons requires clear communication from knowledgeable staff
  • Post-market monitoring (Article 72): Monitoring AI system performance in practice requires operators who can recognize anomalies

Organizations that invest in genuine AI literacy — beyond mere checkbox compliance — will find that other obligations become easier to fulfill, because their personnel actually understand what they are doing and why.
